EMPLOYMENT LAW UPDATE - Two Recent Decisions of the Ontario Human Rights Commission Provide Comfort for Employers, Earl Altman, Employment Law
Two recent decisions by adjudicators at case conferences under the Human Rights Code provide some comfort for employers faced with complaints by employees under the Act.
In a decision rendered on June 10, 2009, an adjudicator considered a claim for alleged discrimination on the basis of family status, contrary to Sections 5 and 9 of the Code. Section 5 provides that “every person has a right to equal treatment with respect to employment without discrimination because of…family status or disability.” Section 9 prohibits anyone from infringing or doing indirectly anything that infringes a right under that section of the Code.

August 3rd, 2009, Civic Public Holiday
The Civic Holiday also known as “Simcoe Day” in the City of Toronto was founded by the Toronto City Council in 1869 to be a “day for recreation”. In 1968 the holiday was renamed in Toronto (still known as a Civic Holiday in the rest of the province) to reflect one of Ontario’s recognizable historical figures “John Graves Simcoe”, the Lieutenant-Governor of Upper Canada.

Work-Sharing 2009
Work-Sharing is an adjustment program designed to help employers and workers avoid temporary layoffs when there is a reduction in the normal level of business activity that is beyond the control of the employer. The measure provides income support to workers eligible for Employment Insurance benefits who are willing to work a temporarily reduced work-week.
